1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of TapCount ("the Application"). By using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Age Restrictions

TapCount is intended for users who are at least 18 years of age. If you are under 18, you may only use the Application under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Application, you represent and warrant that you are at least 18 years old, or that you are using the Application under appropriate parental or guardian supervision.

3. Non-Medical Use & Health Warnings

You acknowledge and agree that:

• The Application measures reaction time and motor performance for personal tracking and fitness optimization only.
• Data provided by the Application should not be used to diagnose, treat, cure, or prevent any medical condition.
• You should consult with a qualified healthcare provider before making any decisions based on the Application's data.
• The Application is not intended to replace professional medical advice, diagnosis, or treatment.

Health and Safety Warnings

Use of this Application may pose risks if you have certain medical conditions. You should not use TapCount if you:

• Have a history of repetitive strain injury (RSI), carpal tunnel syndrome, or similar conditions
• Experience pain, numbness, or tingling in your hands, wrists, or arms
• Have been advised by a healthcare provider to limit repetitive hand or wrist motions
• Have photosensitive epilepsy or any condition triggered by flashing lights or visual stimuli

Safe Use Guidelines:

• Take Regular Breaks: Do not use the Application for extended periods. Take frequent breaks to rest your hands and eyes.
• Stop If You Feel Discomfort: Immediately discontinue use if you experience pain, discomfort, fatigue, or any unusual symptoms.
• Maintain Proper Posture: Use the Application in a comfortable position with proper ergonomics.
• Safe Environment: Never use the Application while driving, operating machinery, or in any situation requiring your full attention.
• Device Protection: Consider using a screen protector to minimize wear from repeated tapping.

4. Data Ownership & Privacy

Your Data, Your Device

TapCount is built with a privacy-first architecture. All performance data generated by the Application is stored locally on your device only.

• No Cloud Storage: Your data is never transmitted to external servers or cloud services.
• No Accounts Required: The Application does not require user registration or account creation.
• No Data Collection: No personal information, usage analytics, or performance metrics are collected by the developer.
• Full Ownership: You retain complete ownership and control of all data generated within the Application.
• Export Freedom: You may export your data to CSV format at any time for personal use or backup.

Data Responsibility

Because all data is stored locally on your device, you are solely responsible for maintaining backups of your data. The developer is not responsible for any data loss resulting from device damage, software malfunction, or device upgrade/replacement.

5. User Responsibilities & Acceptable Use

By using TapCount, you agree to the following responsibilities:

Permitted Use

• You may use the Application for personal, non-commercial purposes only
• You must ensure you are physically capable of performing reaction tests safely
• You are responsible for taking appropriate precautions to protect your device
• You must use the Application in a safe environment where rapid tapping will not cause harm

Prohibited Use

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
• Modify, adapt, translate, or create derivative works based on the Application
• Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices
• Use the Application for any illegal, harmful, or unauthorized purpose
• Attempt to exploit, hack, or circumvent any security measures of the Application
• Use the Application in any way that could damage, disable, or impair its functionality
• Use the Application while operating vehicles, machinery, or in any dangerous situation
• Redistribute, resell, rent, lease, or sublicense the Application to any third party

6. Limitation of Liability

Physical Device Damage

TapCount involves rapid, repeated tapping on your device's screen. While the Application is designed for normal use, the developer is not liable for any physical damage to your device that may result from:

• Forceful or aggressive tapping during reaction tests
• Screen damage, cracks, or scratches resulting from use
• Wear and tear on device hardware from repeated use
• Any other physical damage to the device or its components

General Limitation

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Application
• Any unauthorized access to or use of your device
• Any bugs, viruses, or other harmful code that may affect your device
• Any errors or omissions in the Application's functionality

7. Intellectual Property

The Application, including its original content, features, and functionality, is owned by the developer and is protected by international copyright, trademark, and other intellectual property laws.

8. Warranty Disclaimer

To the maximum extent permitted by applicable law, Educacion Global, Inc and its affiliates expressly disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Application will be uninterrupted, error-free, secure, or virus-free
• Warranties regarding the accuracy, reliability, or completeness of any data or content
• Any warranties arising from course of dealing, usage, or trade practice

No Guarantee of Results: The developer does not warrant or guarantee that use of the Application will improve your reaction time, motor performance, or achieve any specific outcome. Results may vary based on individual factors.

Third-Party Compatibility: The developer does not warrant that the Application will be compatible with your specific device model, iOS version, or any future updates to your device's operating system.

9. Indemnification

You agree to indemnify, defend, and hold harmless Educacion Global, Inc, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Application
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any injury, loss, or damage (including device damage) resulting from your use of the Application
• Any medical conditions aggravated or caused by your use of the Application

This indemnification obligation will survive the termination of these Terms and your use of the Application.

10. Apple App Store Terms

TapCount is distributed through the Apple App Store. Your use of the Application is also subject to Apple's App Store Terms of Service and Usage Rules, which are incorporated herein by reference.

You acknowledge and agree that:

• These Terms are between you and Educacion Global, Inc only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support services for the Application
• Apple is not responsible for addressing any claims by you or third parties relating to the Application
• Apple is not responsible for any product liability claims, intellectual property infringement claims, or claims that the Application fails to conform to legal requirements
• In the event of any conflict between these Terms and Apple's terms, Apple's terms shall control with respect to your use of the App Store
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you

11. Updates and Modifications to the Application

Educacion Global, Inc reserves the right, at any time and without prior notice, to:

• Update, modify, or enhance the Application's features and functionality
• Release new versions of the Application that may require you to download updates
• Temporarily or permanently discontinue the Application or any features within it
• Modify the Application's user interface, design, or performance characteristics

You acknowledge that you may be required to download and install updates to continue using the Application. Some updates may change these Terms, and your continued use constitutes acceptance of the updated Terms.

The developer is not obligated to provide any updates and makes no guarantee regarding future updates, features, or support for the Application.

12. Changes to Terms

The developer reserves the right to modify these Terms at any time. Updated Terms will be posted with a new "Last Updated" date. Your continued use of the Application after any changes constitutes acceptance of the new Terms.

13. Termination

You may stop using the Application at any time by deleting it from your device. These Terms remain in effect until terminated by either party.

Educacion Global, Inc reserves the right to terminate or suspend your access to the Application at any time, with or without cause, with or without notice, if we believe you have violated these Terms or engaged in conduct that we determine to be inappropriate or harmful.

Upon termination, all rights and licenses granted to you under these Terms will immediately cease, and you must promptly delete the Application from your device.

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Limitation of Liability, Warranty Disclaimer, Indemnification, Governing Law, and Dispute Resolution.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Application shall be instituted exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

15. Dispute Resolution

In the interest of resolving disputes efficiently and cost-effectively, you and Educacion Global, Inc agree to the following dispute resolution process:

Informal Resolution

Before filing any formal claim, you agree to first contact us to attempt to resolve the dispute informally. Please send a detailed description of the dispute to our legal contact (provided in Section 19 below) and allow 30 days for us to respond and attempt resolution.

Small Claims Court

Either party may bring an individual action in small claims court in Delaware or in the county where you reside (if the claim qualifies for small claims court jurisdiction), instead of through arbitration or other formal proceedings.

No Class Actions

Limitation Period

Any claim or cause of action arising out of or related to these Terms or the Application must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

16. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms.

The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

17. Entire Agreement

These Terms, together with any other legal notices and agreements published by Educacion Global, Inc in connection with the Application, constitute the entire agreement between you and Educacion Global, Inc concerning the Application.

These Terms supersede and replace any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Educacion Global, Inc regarding the Application.

18. Assignment

Educacion Global, Inc may assign, transfer, or delegate these Terms and its rights and obligations hereunder, in whole or in part, at any time with or without notice, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without the prior written consent of Educacion Global, Inc. Any attempted assignment in violation of this provision shall be null and void.
